2. Description of Services

Qara provides an AI-powered dispatching system designed for service plumbing companies. Our platform answers inbound calls, qualifies callers, books appointments, sends confirmations, and integrates with your existing systems. Qara is not an emergency service provider.

3. SMS Communications

As part of our Services, Qara LLC may send SMS text messages to phone numbers provided by users who have opted in via our website at https://www.qaramind.com/. By providing your phone number and checking the appropriate consent box(es), you agree to receive the following types of messages:

Marketing & Promotional Messages:

• Special offers and discounts
• New product and service updates
• Promotional announcements
• Company news and updates

Non-Marketing (Transactional) Messages:

• Appointment confirmations and reminders
• Call summaries and follow-ups
• Service notifications and updates
• Account-related alerts

Message frequency varies based on your interactions with our Services and the consent options you have selected. Consent to receive SMS messages is not a condition of purchasing any goods or services.

4. SMS Opt-Out Instructions

After opting out, you will receive a one-time confirmation message. No further messages will be sent unless you re-subscribe. Opting out of marketing messages will not affect transactional messages related to active appointments or services unless you opt out of those separately.

5. Message & Data Rates

Standard message and data rates may apply to SMS messages sent and received, depending on your mobile carrier and wireless plan. Qara is not responsible for any fees charged by your carrier. Please contact your wireless provider for details about your messaging plan and any applicable charges.

6. Carrier Liability Disclaimer

Qara, its affiliates, and any third-party service providers involved in delivering SMS messages are not liable for:

• Delayed or undelivered messages due to carrier network issues, technical failures, or circumstances beyond our control
• Charges incurred by your mobile carrier for sending or receiving SMS messages
• Any errors, interruptions, or delays in SMS transmission
• Device incompatibility or software malfunctions

Carriers are not responsible for the content of messages sent through our platform. Message delivery is subject to effective transmission by your wireless carrier and their applicable terms and policies.

7. Eligibility

You must be at least 18 years old and have the authority to enter into these Terms on behalf of your business to use our Services.

8. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You agree to notify Qara immediately of any unauthorized use.

9. Use Restrictions

10. Payment Terms

Fees for the Services are outlined in your subscription agreement. All payments are non-refundable unless otherwise stated. Qara reserves the right to modify pricing with 30 days' notice.

All content, technology, and branding associated with Qara are the exclusive property of Qara. You are granted a limited, non-exclusive license to use the Services during your subscription.

12. Limitation of Liability

To the maximum extent permitted by law, Qara shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Services, including but not limited to lost revenue, data, or profits.

13. Termination

Qara may suspend or terminate your access at any time for violation of these Terms. You may cancel your subscription at any time by contacting our team.

14. Changes to Terms

Qara reserves the right to update these Terms at any time. Continued use of the Services after changes constitutes acceptance of the revised Terms.
